Field User Acknowledgement
Every crew member sees the short version of this once, the first time they sign in to the field app, and taps "I've read this and I agree". This page is the full text.
1. First-sign-in screen
This is the screen every field user sees once, on first sign-in, above one button: "I've read this and I agree". Above the button the screen says: "This is a short summary. By tapping below you agree to the full Field User Acknowledgement, which applies in full, including section 5, which limits Dig Window's liability to you." The full Acknowledgement (sections 2 to 7) is one tap away and governs if anything here differs. Dig Window helps you find and organize your locate paperwork faster. It does not replace it.
1. The locate sheet and what you see on site are what count. Anything this app shows (dates, utilities, colours, the map, the package) is our reading of that paperwork, and it can be wrong. "Valid" or "complete" in this app is not permission to dig.
2. Before you break ground, you confirm from the locate documents and the site that the locate is current, covers your dig area, depth and method, and that the markings are visible and match.
3. If something is missing, expired, unclear, marked STOP or standby, or doesn't match the site, stop and tell your supervisor. Private or unknown lines may not show up in this app at all.
4. A shared locate or a continuation shown in this app still needs the official paperwork behind it.
5. Reminders and expiry warnings are a courtesy. If one doesn't arrive, the responsibility is still yours and your company's. What's on your phone may be out of date if you've been offline.
6. Marking a ticket complete tells your office. It doesn't close, renew or extend the locate.
2. Field user acknowledgement
This Field User Acknowledgement (the "Acknowledgement") is a binding agreement between you, as the individual authorized to use the Dig Window field application, and DigWindow Limited ("Dig Window"). The employer, contractor or other organization that authorized your access (the "Company") has accepted the Dig Window Customer Terms (digwindow.com/terms), which govern the Company's use of the service. A Service Label reflects only the processed state of information within the App and does not constitute a legal or safety determination.
4. Conditions of use
4.1 Nature and limited purpose of the App. The App is provided solely as an administrative and workflow tool. It displays Issued Locate Documents and information extracted, entered, calculated or assembled by Dig Window or the Company. A Package, including one labelled COMPLETE or REVISED COMPLETE, reflects only the material processed when that version was created. No Package, Service Label or other App output constitutes a locate, clearance, safety determination or legal authorization to excavate.
4.2 Issued documents and site conditions govern. The current Issued Locate Documents, visible markings and actual site conditions govern at all times. In the event of any inconsistency between the App and an Issued Locate Document, the Issued Locate Document prevails. If the Issued Locate Documents, markings, intended work or site conditions do not correspond, you must stop work and escalate the matter in accordance with the Company's procedures before work resumes.
4.3 Automated processing. The App uses automated processing, which may include artificial intelligence, and may also display information entered by the Company. No confidence indicator, status or absence from a review queue constitutes confirmation that the information has been reviewed or verified by a person.
4.4 Continuing legal and Company obligations. Private, abandoned, undocumented or unknown infrastructure may exist. You must comply with the Company's procedures for identifying, verifying and protecting such infrastructure.
4.6 Stop and escalate. If any information is missing, expired, unclear, inconsistent or changed, or if any unsafe condition becomes known to you, you must immediately stop work and notify your supervisor or office. Work must not resume until the issue has been resolved in accordance with Applicable Law and Company procedures.
4.7 Markings and expiry. A displayed expiry date does not establish that a locate remains valid or usable where markings are missing, no longer visible, disturbed or inconsistent with site conditions. You must confirm the current Issued Locate Documents and required markings before and during the work to the extent required by Applicable Law and Company procedures.
4.8 Shared locates. Where a locate has been shared with the Company, the App does not constitute or replace the official sharing process. The Company must possess the required source-issued documents and official sharing confirmation, and the proposed work must remain within all applicable location, depth, method, time and other restrictions.
4.9 Continuation after expiry. Where Applicable Law permits a locate to continue beyond its ordinary expiry, any continuation status displayed in the App is an administrative workflow aid only. The Company must possess the required official continuation documentation and continue to satisfy all applicable conditions. You must review available synchronization information and comply with the Company's procedures for confirming that current documents are available before relying on them. The App may also be unavailable, or may need to be reloaded or updated, while Dig Window or its service providers carry out maintenance or updates, and an update may change how information is displayed. Keep the App updated, and follow the Company's procedures for obtaining the Issued Locate Documents whenever the App is unavailable.
4.11 Ticket completion. If the App permits you to mark a ticket as complete, that action records an internal workflow status only and has no legal effect on the locate. It does not close, cancel, renew, extend, validate or otherwise alter the status of a locate.
4.12 Account and device security. Your access credentials are personal to you and must not be shared or made available to any other person. You must promptly notify the Company if your device is lost, stolen, replaced, compromised or no longer used for work. Locate information stored on a device is controlled by the Company and may be removed when your access ends.
4.13 Information recorded by the App. The App may record account identity, sign-ins, acceptance of this Acknowledgement, device, browser and session information, synchronization activity, ticket and Package access, completion actions. Your phone's location is used on the phone to show where you are on the map and is not sent to Dig Window. The Company is responsible for providing any workplace-monitoring notice, policy or consent and for establishing any other lawful authority required for its use of that information. Dig Window processes Personal Information in accordance with its Privacy Policy (digwindow.com/privacy) and the Company's agreement with Dig Window.
4.14 Acceptable use. You must not alter, falsify or misrepresent any Issued Locate Document; present an App screen or Package as a source-issued document where doing so would be misleading; share access credentials; copy, disclose or use data for an unauthorized purpose; circumvent access controls; probe or test the App's security; interfere with the App; or use the App in contravention of Applicable Law.
4.15 Suspension of your access. Dig Window or the Company may suspend or end your access to the App at any time. The Company, not Dig Window, decides whether work proceeds.
5. Reliance and limitation of liability

You must not rely on any such output as a substitute for the Issued Locate Documents, site conditions, required markings or the Company's verification procedures.
5.2 Limitation of liability. To the maximum extent permitted by Applicable Law, Dig Window shall not be liable to you, whether in contract, tort (including negligence), breach of statutory duty, equity or otherwise, for any loss, damage, delay, cost, injury, expense or claim arising out of or relating to your access to, use of, or reliance on the App or any information displayed, omitted, delayed or made available through the App, including any error, omission, outage, delayed update or stale or offline copy. This section does not apply to bodily injury or death, does not exclude or limit liability that cannot lawfully be excluded or limited, and does not affect any right or benefit you have under the Workplace Safety and Insurance Act, 1997 or against your employer.
5.3 Why this section applies. You are given access to the App at no charge to you, on the basis of this Acknowledgement. Nothing in this Acknowledgement requires you to pay Dig Window anything or to indemnify anyone.
